Homegrown Clones Canada – Terms and Conditions of Sale

1. Acceptance of Terms

By placing an order on this website, you confirm that you have read, understand, and agree to be bound by these Terms and Conditions in their entirety. These Terms constitute a legal agreement between you and Homegrown Clones Canada.

2. Legal Compliance and Eligibility

  • a. Age of Majority: You must be of legal age (19 in most provinces, 18 in Alberta) to purchase cannabis clones in the province to which the order is being shipped. By placing an order, you warrant that you meet this age requirement.
  • b. Personal Cultivation Limit: You acknowledge and affirm that your purchase respects the maximum legal limit of four (4) cannabis plants per household as set out under the Cannabis Act (Canada).
  • c. Provincial Compliance: You are solely responsible for ensuring that the possession and cultivation of cannabis clones are legal within your specific provincial and municipal jurisdiction. We reserve the right to cancel any order originating from a province where the sale or shipment of cannabis plants is restricted (specifically Quebec and Manitoba, where shipping is prohibited).

3. Products and Availability

  • a. Product Status: All clones are sold as “starter plants” or “fully rooted clones” intended for personal, non-commercial cultivation.
  • b. Strain Accuracy: We make every effort to ensure strain accuracy. However, in the event of an unforeseen inventory or labeling error, we reserve the right to substitute a similar strain or issue a refund for the affected item.

4. Pricing and Payment

  • a. Pricing: All prices listed on the website are in Canadian Dollars (CAD) and represent the final price per clone.
  • b. Order Acceptance: Your order is not accepted, and a contract of sale is not formed, until we confirm receipt of your full E-Transfer payment. Until this confirmation, we reserve the right to cancel or refuse any order.
  • c. Payment Method: Payment is accepted exclusively via Interac E-Transfer in accordance with our instructions provided at checkout. Orders unpaid within 24 hours may be cancelled without notice.

5. Shipping, Risk, and Liability

  • a. Shipping Fees: Shipping fees are calculated at checkout based on the total quantity of products ordered.
  • b. Risk of Loss: Title and risk of loss for all products pass to you upon our delivery of the package to the shipping carrier (Canada Post or courier). We are not responsible for packages that are delayed, damaged, or lost after they have been handed to the carrier.
  • c. Delivery Issues: We are not liable for shipping delays caused by carrier disruptions, weather, or incorrect address information provided by the customer.
  • d. Arrive Alive Guarantee (Live Arrival): * We guarantee all clones will arrive alive and healthy, meaning they will not exhibit death or catastrophic damage (e.g., completely desiccated, frozen solid, or destroyed beyond recovery) upon delivery. Minor cosmetic damage (yellowing leaves, minor wilting) due to shipping stress is normal and not covered.
    • Claim Requirement: To activate this guarantee, the customer MUST notify Homegrown Clones Canada by email within 6 hours of the confirmed delivery time provided by the carrier’s tracking and include clear, date-stamped photographic evidence of the damage and the original packaging.
    • Voided Guarantee: The guarantee is VOID if: (1) The customer fails to provide a secure or deliverable address; (2) The package is left unclaimed at an outdoor mailbox or delivery depot for more than 4 hours after the initial delivery attempt notification; (3) The customer instructs the carrier to leave the package unattended in conditions where temperature or security is compromised.
    • Remedy: If a valid claim is approved, we will offer a one-time replacement of the damaged clone(s), provided that the strain is in stock. The customer is responsible for the shipping cost of the replacement order. No cash refunds are provided under this guarantee.
  • e. No Guarantee of Survival: Once the package is opened and the clones are in the customer’s possession, we have no control over their care or environment. We offer no warranty or guarantee on the clone’s survival, growth, or eventual yield.

6. Cancellations and Refunds

  • a. Order Cancellation: Orders may be cancelled by the customer only before the E-Transfer payment is sent. Once payment is received, the order is considered final and cannot be cancelled or refunded.
  • b. Refunds: Due to the perishable nature of the product, all sales are final. We do not offer returns or refunds except in cases where we cancel the order due to non-compliance (Section 2) or inventory issues (Section 3).

7. Intellectual Property

The content of this website, including all original text, product descriptions (excluding public strain names), photographs of the clones, graphics, and the Homegrown Clones Canada logo and branding, is the property of Homegrown Clones Canada and is protected by copyright law. You may not use, reproduce, or distribute this protected content without explicit written permission.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Ontario, and the federal laws of Canada applicable therein.
